Welcome to Video Crews PR (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, any online scheduling or client portals, our production and post-production services, and participation in our SMS text message program (collectively, the “Services”). By accessing or using our Services, you agree to these Terms. If you do not agree, please discontinue use immediately.

1. Overview of Services

Video Crews PR provides professional film-quality video production and studio-grade photography across Puerto Rico, including (without limitation): camera-crew hire, event & conference capture, live streaming, testimonial/interview production, training & compliance content (HIPAA/OSHA-aware), advertising/brand films, and drone/aerial cinematography, plus post-production (editing, color, captions, graphics). Through our website and SMS program, customers may receive updates, scheduling links, project communications, and promotional offers.

2. Eligibility

By using the Services, you represent that you are at least 18 years old (or have parental/guardian consent), and that you will use the Services only for lawful purposes in accordance with these Terms.

4. Account Registration

If you create an account, book through our portal, or collaborate via shared folders, you agree to provide accurate, current information and to safeguard your login credentials. You are responsible for all activity under your account.

5. Promotions and Offers

Promotions/discounts are subject to separate terms, may not be combined unless stated, and may carry expiration or geographic limits. We may modify or end promotions at any time.

6. Use of Website and Services

You agree not to: (a) use the Services for unlawful purposes; (b) interfere with or disrupt the website, servers, or networks; (c) reproduce, sell, or exploit any portion of the Services without our written consent. We may suspend or terminate access for violations of these Terms.

7. Intellectual Property

All website content—including text, graphics, images, logos, videos, layouts, and software—is the property of Video Crews PR or its licensors and is protected by applicable intellectual-property laws. Unauthorized use is prohibited.

8. Ownership & Licensing of Deliverables

Final Edited Videos & Photos (Master Exports). Upon full payment, you receive a perpetual, worldwide license to use the final edited deliverables across the channels specified in your Statement of Work (“SOW”) or written estimate (e.g., website, social, internal communications, events). Broadcast/paid ads/OOH or additional channels require that your SOW include those media (or be amended).

Raw Footage & Project Files. Unless expressly transferred in writing, camera originals, project files (e.g., Premiere/Resolve timelines), working assets, and behind-the-scenes materials remain the property of Video Crews PR. We can license access, provide selects/full rolls, or transfer ownership for an additional fee (which may include releases, union/crew considerations, and third-party license upgrades).

Third-Party Assets (Music/Stock/Fonts/Templates). These are licensed, not sold, and are typically non-transferable. Usage is limited to the final edits and channels/seats/terms specified by the vendor license. Expanded usage may require additional license fees.

Talent/Location Releases. We secure releases consistent with the intended usage in your SOW. Expanded usage may require additional permissions or fees.

9. Content Security, Backup & Retention

We practice professional media handling (e.g., checksum DIT on set, local/remote backups). Unless your SOW states otherwise, we retain raw materials for 90 days after final delivery and may archive or purge thereafter. We can provide extended archival or off-cycle retrieval as a paid service. Sensitive/regulated shoots can be handled under NDA with additional security measures as requested.

10. Production Scheduling, Deposits & Cancellations

Project schedules, crew bookings, and gear holds are confirmed only after written approval and a deposit (amount/timing per SOW). Cancellations/reschedules may incur fees for crew, locations, permits, rentals, or other non-refundable costs already committed. Weather/force-majeure rebooks will follow commercially reasonable efforts and SOW terms.

11. Safety, Compliance & Aerial Operations

We follow reasonable industry practices and comply with applicable laws and venue/site rules. For regulated content (e.g., HIPAA/OSHA), we will incorporate compliance steps agreed in the SOW. Aerial operations are conducted by FAA-compliant pilots with required permits/insurance where applicable. You agree to disclose site hazards, restrictions, or special approvals that could affect production.

12. Third-Party Links

Our website may link to third-party sites for convenience. We are not responsible for their content, policies, or practices.

13. Limitation of Liability

To the fullest extent permitted by law, Video Crews PR and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, or goodwill, arising out of or related to the Services, whether foreseeable or not.

14. Indemnification

You agree to indemnify and hold harmless Video Crews PR, its affiliates, owners, and personnel from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your breach of these Terms, or your violation of law or third-party rights.

15. Disclaimers

The Services are provided “as is” and “as available.” We make no warranties—express or implied—regarding accuracy, completeness, fitness for a particular purpose, or non-infringement. Production outcomes can depend on third-party factors (venues, connectivity, weather, platform rules, etc.).

16. Messaging Compliance

We comply with the Telephone Consumer Protection Act (TCPA), CTIA Guidelines, and other applicable messaging regulations. Your opt-in/opt-out controls are honored as described in Section 3.

17. Governing Law

These Terms and any dispute shall be governed by and construed under the laws of the Commonwealth of Puerto Rico, without regard to conflict-of-law principles. Venue and jurisdiction shall lie in the competent courts located in Puerto Rico.

18. Changes to These Terms

We may update these Terms from time to time. Changes will be posted here with a new “Last Updated” date. Your continued use of the Services after changes constitutes acceptance.
